End User License Agreement (EULA)

1. Introduction

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Matthew Dickerson ("Developer") for the Habimon mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.

2. Age Requirement

You must be at least 9 years old to use this App. If you are under 18, you must have your parent or legal guardian's permission to use the App and agree to these terms. By using the App, you represent that you meet these age requirements.

3. License Grant

Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial purposes
• Access and use the features and content within the App

This license is also subject to the usage rules set forth in the Apple App Store Terms of Service.

4. Restrictions

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Redistribute, sell, rent, lease, or sublicense the App
• Use the App for any commercial purpose without written permission
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Circumvent any security features or access restrictions
• Use the App in any unlawful manner or for any illegal purpose

5. Intellectual Property

All content, features, functionality, code, designs, graphics, monsters, and other materials in the App are owned by the Developer and protected by copyright, trademark, and other intellectual property laws. The Habimon name, logo, and all related marks are trademarks of the Developer.

6. Subscriptions and Purchases

Habimon Pro Subscription

The App offers an optional "Habimon Pro" subscription that provides access to premium features including:

• Unlimited habits (vs. 4 free habits)
• Access to all 12 regions (vs. Lazy Lagoon only)
• Battle all 150+ monsters (vs. first 15 only)
• Challenge Mode gameplay
• Custom themes
• All weapons and spells

Free Trials and Promotional Offers

• New subscribers may be eligible for a free trial period or promotional offers
• Free trial duration will be clearly displayed before you subscribe
• You will not be charged during the free trial period
• If you do not cancel before the trial ends, you will be automatically charged for the subscription
• Promotional offers may have specific eligibility requirements and limitations
• Only one free trial per user; previously subscribed users are not eligible

Auto-Renewal and Cancellation

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Manage or cancel subscriptions in your device's App Store settings
• Payment is charged to your App Store account at confirmation of purchase (after any free trial period)
• Subscription fees are generally non-refundable except as required by law

Payment Processing

Subscription payments are processed by Apple through the App Store. We use RevenueCat, a third-party service, to manage subscription status and entitlements. RevenueCat collects minimal anonymous data necessary for subscription management. See our Privacy Policy for more details.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy. Key points:

• All habit tracking and game data is stored locally on your device using JSON
• Only anonymous subscription data is collected via RevenueCat
• Optional iCloud sync uses Apple's end-to-end encryption
• We cannot access your habits, monsters, or game progress

8. MEDICAL DISCLAIMER

CRITICAL: READ CAREFULLY

Habimon is explicitly NOT a medical device and is NOT intended to:

• Diagnose, treat, cure, or prevent any disease or medical condition
• Replace professional medical advice, diagnosis, or treatment
• Manage medications or critical health tasks
• Treat ADHD, depression, anxiety, or other medical/mental health conditions

DO NOT rely on Habimon for medication reminders or critical medical tasks without a proper backup system. Always consult qualified healthcare professionals for medical advice.

The App is NOT approved by the FDA, MHRA, or any other healthcare regulatory authority.

9. Warranties and Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties that the App will be uninterrupted or error-free

The Developer is not responsible for:

• Data loss or corruption
• iCloud sync failures or conflicts
• Device compatibility issues
• App Store availability or interruptions

10. Limitation of Liability

To the maximum extent permitted by law:

• The Developer's total liability is limited to the amount you paid for the App in the 12 months prior to the claim, or £75 GBP, whichever is less
• The Developer is NOT liable for any indirect, incidental, special, consequential, or punitive damages
• The Developer is NOT liable for data loss, lost profits, or business interruption
• The Developer is NOT liable for missed tasks, forgotten habits, or health impacts

YOU USE THE APP AT YOUR OWN RISK.

11. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this Agreement.

The Developer may terminate or suspend your access to the App at any time for:

• Violation of this Agreement
• Fraudulent, abusive, or illegal activity
• Legal requirements or court orders

Upon termination, you must cease all use of the App and delete all copies from your devices. Subscription fees paid are non-refundable upon termination.

12. Changes to Terms

The Developer reserves the right to modify this Agreement at any time. Material changes will be communicated through:

• App Store update notes
• In-app notifications
• Email (if provided)

Continued use of the App after changes constitutes acceptance of the modified Agreement.

13. Governing Law and Jurisdiction

This Agreement is governed by the laws of England and Wales. Any disputes arising from this Agreement or your use of the App will be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in this Agreement affects your statutory rights as a consumer under UK law or the law of your country of residence.

14. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained.

In particular, but without limitation, the App may not be exported or re-exported into any U.S.-embargoed countries or to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the App, you represent and warrant that you are not located in any such country or on any such list.

15. Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and the Developer regarding the App and supersedes all prior agreements and understandings.
